Terms of Service

Effective date: 20 June 2026 · Updated: 12 July 2026 (paid subscriptions, free-tier persistence) · Provider: Nedim Agic, sole proprietor (Einzelunternehmen, trading as "United DigiArt Vision"), Krossensee 2a, 91361 Pinzberg, Germany ("openpouch", "we", "us").

1. Agreement

These Terms govern your use of the openpouch hosted service at openpouch.sh and related APIs, CLI, and endpoints (the "Service"). By using the Service you agree to these Terms. If you use the Service on behalf of an organization, you represent that you may bind it. The Service is directed at businesses, developers and professional users (B2B) and is not aimed at consumers.

The open-source openpouch software is licensed separately under Apache-2.0 and is not governed by these Terms.

2. The Service

openpouch is agent-native hosting: it builds and runs applications you (or an agent acting for you) submit, and returns a live URL. The Service is an early-stage product: it is provided "as is", may change or be discontinued, and carries no availability guarantee or SLA. Paid tiers add capacity and operating features (always-on apps, persistent volumes), not an SLA.

You must not use the Service to:

We run submitted code in isolated, resource-limited, egress-filtered containers; you remain responsible for what you deploy.

5. Your content

You retain all rights to the code and content you submit ("Your Content"). You grant us a limited license to store, build, execute, transmit, and display Your Content solely to operate the Service for you. You represent that you have the rights to submit Your Content and that it complies with Section 4.

Deployments are ephemeral by default: unclaimed previews are deleted after about 72 hours; claimed previews after about 7 days (see the product docs for current values). Do not rely on the Service as durable storage or as a backup.

6. Suspension and takedown

We may suspend an account or remove any deployment without prior notice if we reasonably believe it violates these Terms, is unlawful, threatens the Service or third parties, or in response to a valid legal request or abuse report ([email protected]). Where practical we will inform you and state the reason.

7. Fees and paid subscriptions

The instant lane and the free account tier are free of charge.

7.1 Paid subscriptions

Paid plans are sold by our Merchant of Record, Paddle.com Market Ltd / Paddle.com Inc. ("Paddle"). Paddle is the seller of record for the transaction: it runs the checkout, issues the invoice, collects applicable taxes (e.g. VAT/sales tax), and processes payments and refunds. Paddle's buyer terms apply to the purchase alongside these Terms. We never receive your full payment details.

Subscriptions renew automatically for successive billing periods until cancelled. You can cancel at any time via the Paddle-hosted billing surface or by contacting us; cancellation takes effect at the end of the current billing period. After a downgrade or cancellation your account returns to the free tier non-destructively: existing deployments and data remain, and only new work beyond the free-tier limits is rejected with an explicit error.

Prices are shown at checkout. We may change prices for future billing periods with at least 30 days' notice by email; if you do not agree, cancel before the change takes effect. Eligible early accounts ("founder cohort") check out at the launch prices published at the time; this preferential price applies for as long as the subscription remains active and is not transferable.

If a renewal payment fails, Paddle retries and contacts you (dunning). During that period your plan may remain active; if payment ultimately fails, the account returns to the free tier as described above.

Refunds are handled according to our Refund Policy.

7.2 Free-tier persistence

Anonymous instant deployments expire about 72 hours after deploy. Claiming a deployment with the claim link extends it to 7 days. Deployments owned by an account stay live as long as they are used: they expire only after about 90 consecutive days without a single request, and we send a warning email to the account address about 7 days before such an expiry. Any request resets the clock. We may adjust these windows; changes apply prospectively and are announced on the website.

8. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind (express or implied), including merchantability, fitness for a particular purpose, availability, or non-infringement, to the maximum extent permitted by law. The Service is an early-stage product and may contain errors or be interrupted.

9. Limitation of liability

To the extent permitted by applicable law: we are liable without limitation only for intent and gross negligence, and for injury to life, body, or health, and under mandatory statutory liability (e.g. the German Product Liability Act). For slightly negligent breach of a material contractual obligation ("Kardinalpflicht"), our liability is limited to the foreseeable, contract-typical damage. Any further liability is excluded. As the preview is provided free of charge, statutory limitations for gratuitous services may further reduce our liability.

10. Indemnification

You will indemnify us against third-party claims arising from Your Content or your use of the Service in breach of these Terms, to the extent you are responsible, within the limits of applicable law.

11. Term and termination

You may stop using the Service and delete your account at any time. We may terminate or suspend access for the reasons in Section 6, or on reasonable notice when discontinuing the preview.

12. Changes to these Terms

We may update these Terms; material changes will be announced (e.g. on openpouch.sh or by email). Continued use after the effective date constitutes acceptance.

13. Governing law and venue

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rights of your country of residence remain unaffected. Venue, to the extent permitted, is the registered seat of the provider (Pinzberg, Germany).
